The use of Alternative Dispute Resolution (ADR) continues to grow. The
most common forms of ADR - mediation and conciliation - can now be found
as recognised processes within tribunals, courts and a range of professional
and regulatory bodies throughout Australia.
Most people participating in mediation for the first time are uncertain
of the process and may inappropriately draw on media images of the adversarial
court system as a reference for their involvement.
This package, provides participants in mediation and others involved
in settling disputes with important information on how to prepare and
participate in the process - effective mediation relies very much on a
sound understanding of the process by participants.
Mediation is based on a number of important principles and processes
which ensure an opportunity for issues to be properly identified, disputants
to have their say and resolutions to be fairly negotiated. The video training
package offers an excellent medium by which both the principles and processes
of mediation and the nuances of human interactions, which are integral
to mediation, can be effectively presented and discussed.
The package is comprised of:
* A 15 minute video presented by ABC TV personality - Julie McCrossin,
which features mediations in action and interviews with participants,
jointly produced with the Victorian Civil and Administrative Tribunal
(VCAT)
* A User Guide detailing best practice for both mediators and participants
and
* Training Notes including group activities and 'self paced learning'
exercises.
This package, is an important tool for a number of services and industries,
including:
providers of mediation services;
human resource personnel within private industry and government dealing
with staffing or industrial disputes;
customer complaints units within industry and government, with a particular
focus on retail and service industries and local government;
agencies dealing with disputes between clients and product and service
providers, e.g. community legal centres, financial counselling services;
agencies dealing with relationship disputes such as family counsellors,
youth service workers, social workers;
secondary and tertiary educational institutions teaching in the area
of ADR.
Note: To enable VCAT applicants to adequately prepare for their mediation,
VCAT will make this video available to applicants through daily screenings.
